REASON #2
Over 40 CM credits available including 1.5 LAW CM for
“The Role of the Planner in Land Use Litigation” by Allen Kracower
At some point in the career of every planner there comes a time when
you will
be asked to testify in a trial court regarding land use and zoning, or
perhaps eminent domain. Trial court testimony is very different from
speaking
or testifying before a planning commission or zoning board. You will
have to
determine if you are actually qualified as an expert given the
Illinois Supreme Court rules
regarding expert
qualifications. If selected as an expert what Illinois land use and
zoning
law must you know? What is the most important case law in Illinois and
what
does it mean in terms of your testimony? What is a deposition and what
are
the rules for testifying at a deposition? How will you present
yourself and how
do you prepare for a deposition and a trial? Will you need any graphic
exhibits and should they be presented electronically or on boards,
finally
and perhaps most importantly can you ethically be an expert in a given
case?
This seminar will include the following: Ethical Conduct; How to
Present
Yourself. Testifying at a Deposition: Preparation for Depositions and
Trials;
Graphic Exhibits and Electronic Presentations; Types of Land Use
Litigation;
Introduction to Zoning Litigation and Eminent Domain Litigation; Land
Use and
Zoning Case Law for Zoning cases; The LaSalle Nat’l Bank of Chicago v. County of Cook; Sinclair
Pipeline Co. v.
Village of Richton Park; City of Chicago Height v. Living Word
Outreach Full
Gospel Church (Special uses).
*** Don't forget to book your room at
new Marriott Hotel and Conference Center
located
in the midst of Normal's vibrant and historic commercial center. Its
unique
