Code Review and Revision
The Town of Centreville, Maryland
Submittal Deadline: June 25, 2007
SOPE OF SERVICES
The following is a general scope of services for updating the portions
of the Code that are required to meet the intent of the WRAS. This scope
is an outline of the goals that the Town would like to achieve and is an
outline of what is anticipated in order to complete the project.
However, it is the consultant's responsibility to modify the scope based
on his/her professional experience in order to meet the objectives of
the Town. The consultant shall submit a detailed scope of services that
meets the Town's objectives. It is expected that the consultant will
work closely and receive direction from staff. In addition, the Town is
in the process of forming a group of stakeholders that will assist in
the guidance of this update by virtue of a Committee. The Committee will
consist of Town residents with varying degrees of expertise and
interests. The Committee will meet with the consultant, at a minimum,
monthly to discuss the process, proposed changes/updates and evaluate
the consultant's progress.
For all proposed changes in the Town Code the consultant must quantify
expected nutrient reductions for each scenario in order for the best
management practice to be implemented.
Stormwater Management and Drainage Criteria
Queen Anne's County Department of Public Works currently reviews all
stormwater management requirements for the Town. The Town does not have
its own Code addressing this issue. However, the Town is currently
working with the County in its publication of a new Low Impact
Development Guidance Manual. It is anticipated that this will eventually
result in an Ordinance update at the County level requiring more
stringent stormwater quality and quantity control.
It will be the responsibility of the consultant to evaluate the
Town/County stormwater relationship in order to introduce Code changes
that will not adversely affect the coordination the Town currently
enjoys with the County.
In addition, a Town of Centreville Master Plan regarding the management
of stormwater and the mapping of impervious surfaces is currently
underway. It is expected the result of this study will produce a series
of recommendations related to stormwater management and impervious
surface coverage. The results of this study and any ongoing coordination
with that consultant will be an integral part of the final work product.
Staff will work to ensure that the work products are complimentary.
The consultant will need to review the current language within the draft
2007 Centreville Community Plan to determine what changes will be
required to bring it and the Town Code into compliance with the specific
requirements for the Water Resources Element under MD House Bill 1141.
Zoning Ordinance and Subdivision Regulations
The intent of the update to the Zoning and Subdivision regulations is to
provide for a clear, streamlined approach to project development review
that is consistent with the goals of the WRAS. Over a period of many
years the Code has been amended to keep pace with County, State and
Federal regulations as well as with the changes in the character and
population growth in the Town. The consultant will be required to review
this portion of the Code for consistency and ease of use as well as
addressing some key components as they relate to low impact development
techniques to be applied in the Code revision. Specifically the
consultant should evaluate, but should certainly not be limited to the
following:
* Street widths
* Street lengths
* Right of way widths
* Cul-de-sacs size
* LID stormwater practice and incentives in the subdivision
regulation
* Parking ratios
* Parking codes
* Parking lots and space sizes
* Open space design
* Setbacks and frontages
* Sidewalks
* Driveways
In addition, the Town is considering delineating a long term boundary by
establishing a "halo" of preserved land. The proposed limits of the Town
are found on the 2007 draft of the Centreville Community Plan. It will
be the consultant's responsibility to develop options for the Town to
consider in order to provide for the establishment of this "halo"
through the transfer of development rights, open space easements, or
other vehicles within the land use code.
Urban Tree Canopy Ordinance
The Town of Centreville does not have an Ordinance that addresses the
needs of the establishment and/or protection of the urban canopy. There
are a variety of different ordinance structures which seem to serve
communities' needs. The Town wishes the consultant to draft an Ordinance
to specifically address the needs of the urban canopy. The Town
currently has a Forest Conservation ordinance. It will be up to the
consultant to address the particular requirements under the County and
State and those suggested by the Committee. There will be a general list
of points to consider which the ordinance may include. As with all
changes in the Town Code, continuity within the ordinance, compatibility
with other ordinances, consistency with the community vision, and
political will for enforcement are all important issues for
consideration.
Requirements for private land owners with respect to development
activities
Included in this section would be language describing any restrictions,
permits, or requirements for the various types of development
activities, requirements for protection and limits of construction
activity, tree removal, replanting, mitigation, etc. This may include
the requirement for those conducting land disturbing activities to file
tree location and assessment plans, tree protection plans, landscape
plans, replanting plans, or other plans deemed necessary by the
ordinance or arborist. Require significant bonding to ensure the
required planting and survivability rate is obtained.
* Requirements for retrofitting both public and private land to
come into compliance with the new code.
* Requirements for public land for private individuals conducting
tree impacting activities, tree planting, and maintenance.
* Provide for specimen tree protection and specimen stand
protection and permits and penalties as required.
* Develop specifications for species and quality of tree to be
planted within the community on properties governed by the tree
ordinance.
* Define buffer requirements for protection of root systems and
for provisions for sound and visual buffers in association with land use
changes.
* Establish penalties for violations, variance procedures,
administrative and economic penalties and mechanisms for administrative
appeals.
